Terms and Conditions

Please read these terms and conditions carefully before using Priority Delivery Services. By using our services, you agree to be bound by these terms.

Limited Liability

Priority Delivery Services' liability for loss, damage, or delay of any package is limited to a maximum of $100.00 CAD per package, regardless of the actual value, declared value, or contents of the package.

This limitation applies to all claims, including but not limited to loss, damage, delay, misdelivery, or non-delivery, regardless of the cause or circumstances. The $100.00 limitation is the maximum amount we will pay for any single package, even if the package contains items of greater value.

Customers are strongly advised to obtain appropriate insurance coverage for packages valued in excess of $100.00. Priority Delivery Services does not provide additional insurance coverage beyond this limited liability amount.

1. Service Terms

Priority Delivery Services ("we," "us," or "our") provides courier and delivery services throughout Metro Vancouver and the Lower Mainland. By booking a delivery or using our services, you ("customer," "you," or "your") agree to these terms and conditions.

We reserve the right to refuse service to anyone at our discretion. We may also refuse to transport any package that violates these terms, contains prohibited items, or poses a safety risk.

2. Payment Terms

Payment is due at the time of booking or upon delivery, as specified in your service agreement. We accept payment by credit card, debit card, or other methods as specified at the time of booking.

All prices are in Canadian dollars (CAD) and are subject to applicable taxes. Prices may vary based on distance, urgency, package size, weight, and other factors. Quotes provided are estimates and final charges may differ based on actual service requirements.

In the event of non-payment or payment dispute, we reserve the right to withhold delivery, refuse future service, and pursue collection of outstanding amounts, including reasonable collection costs and legal fees.

3. Delivery Terms

Delivery times are estimates and not guaranteed. While we strive to meet all delivery commitments, we are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to traffic, weather, accidents, road closures, or recipient unavailability.

It is the customer's responsibility to provide accurate pickup and delivery addresses, contact information, and delivery instructions. We are not liable for delays or failed deliveries resulting from incorrect or incomplete information.

If a delivery cannot be completed due to recipient unavailability or other issues, we will make reasonable attempts to contact the recipient. Additional charges may apply for re-delivery attempts or storage of packages.

We reserve the right to leave packages at the delivery address if no one is available to receive them, provided it appears safe to do so. The customer assumes all risk for packages left unattended.

4. Prohibited Items

The following items are prohibited and will not be accepted for transport:

  • Hazardous materials, including flammable, explosive, corrosive, or toxic substances
  • Illegal drugs, controlled substances, or contraband
  • Firearms, ammunition, or weapons of any kind
  • Perishable items requiring refrigeration (unless specifically agreed upon)
  • Live animals (unless specifically agreed upon)
  • Currency, cash, or negotiable instruments
  • Precious metals, gems, or jewelry valued over $100
  • Items that violate any applicable laws or regulations

If a prohibited item is discovered, we reserve the right to refuse transport, return the item to the sender, or dispose of it as required by law. The customer will be responsible for all costs and will not be entitled to any refund.

5. Packaging Requirements

Customers are responsible for properly packaging all items to ensure safe transport. Packages must be securely sealed and clearly labeled with recipient information.

We are not liable for damage to items that are inadequately packaged, fragile, or improperly secured. Items should be packaged to withstand normal handling during transport.

For valuable or fragile items, we recommend using appropriate protective packaging materials and clearly marking packages as "Fragile" or "Handle with Care."

6. Claims Process

All claims for loss, damage, or delay must be submitted in writing within 30 days of the delivery date (or expected delivery date for lost packages). Claims submitted after this period will not be considered.

To file a claim, please contact us at support@prioritydelivery.ca with the following information:

  • Tracking number or delivery reference
  • Description of the issue (loss, damage, delay)
  • Photographs of damaged items (if applicable)
  • Proof of value (receipts, invoices, or appraisals)
  • Any other relevant documentation

We will investigate all claims and respond within 30 days. Our liability is limited to the amount specified in the Limited Liability section above ($100.00 per package maximum).

7. Force Majeure

We are not liable for any failure or delay in performance under these terms resulting from circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, or severe weather
  • War, terrorism, civil unrest, or government actions
  • Labor strikes, work stoppages, or other labor disputes
  • Pandemics, epidemics, or public health emergencies
  • Traffic accidents, road closures, or infrastructure failures
  • Mechanical failures or vehicle breakdowns
  • Any other circumstances beyond our reasonable control

8. Indemnification

You agree to indemnify, defend, and hold harmless Priority Delivery Services, its employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these terms and conditions
  • Your violation of any applicable laws or regulations
  • Your shipment of prohibited items
  • Any injury or damage caused by the contents of your packages
  • Any claims by third parties related to your use of our services

9. Privacy and Data Protection

We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

We may share delivery information with recipients and may use your information to provide, improve, and market our services. We take reasonable measures to protect your personal information, but cannot guarantee absolute security.

10. Modifications to Terms

We reserve the right to modify these terms and conditions at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

If you do not agree to any modifications, you must discontinue use of our services immediately.

11. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

12. Severability

If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
